Agreement to these Terms

These Terms of Service (Terms) are an agreement between you and Abhinav Khanger (we, us, or our) for your use of Alcohol Tracker° and the related website (together, the Service). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service for an organization, you confirm that you have authority to accept these Terms for that organization.

Eligibility and responsible use

Alcohol Tracker° is intended for adults and is rated 18+ on the App Store. You may use the Service only when doing so is lawful where you live and in a way that does not encourage unsafe drinking or harm to yourself or anyone else.

You are responsible for the information you enter, the decisions you make, and the people who can access your device. Do not use the Service while driving or in a way that distracts you from immediate safety.

The Service and offline use

The Service helps you record drinks and view calculations or summaries such as alcohol units, standard drinks, calories, cost, dry days, and estimated BAC. Core tracking is designed to work offline and your diary is intended to remain on your device. There is no account creation, cloud diary, or promise of cross-device synchronization.

Some features require a network connection, including purchase validation, entitlement restoration, analytics delivery, diagnostics, remote configuration, or links to third- party services. Offline analytics events may be queued on your device and sent later.

We may add, change, suspend, or remove features, including offline behavior, as the Service develops. We do not promise that any particular feature will always be available or that local data can always be recovered.

Health, BAC, and safety disclaimer

Never use an Alcohol Tracker° estimate to decide whether to drive. If you have been drinking, arrange a sober alternative to driving.

The Service is for general educational and self-tracking purposes. It is not medical advice, diagnosis, treatment, a medical device, a laboratory test, or an emergency service. Estimated BAC and time-to-zero values are models based on incomplete and user-supplied information. They can be materially different from a person’s actual BAC or impairment and do not establish whether conduct is legal or safe.

Do not use the Service to manage an emergency, withdrawal, pregnancy, medication interaction, medical condition, or suspected alcohol poisoning. Contact a qualified healthcare professional or emergency service when appropriate. Do not suddenly stop heavy or long-term drinking without medical guidance if withdrawal may be possible.

License to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the app on Apple devices that you own or control for your personal, non-commercial use.

You may not copy, sell, rent, lease, distribute, sublicense, modify, adapt, translate, reverse engineer, decompile, disassemble, attempt to derive source code, or create derivative works from the Service except to the extent that applicable law expressly permits it. You may not remove copyright, trademark, or other proprietary notices.

Acceptable use

You agree not to use the Service to break the law, infringe another person’s rights, interfere with its operation, probe or bypass security, introduce malware, scrape or overload the website, impersonate another person, or use automated means to access the Service in a way that harms us or other users. We may investigate suspected misuse and take proportionate action, including limiting access.

Purchases and subscriptions

The app is free to download and may offer optional in-app purchases, including subscriptions or a lifetime unlock. The price, billing period, trial terms (if any), and features included will be shown before you purchase. Prices and availability may vary by country and may change as permitted by law.

Purchases are made through Apple’s App Store and billed to your Apple Account. Apple’s Media Services Terms and Conditions, payment rules, and refund policies apply to those transactions. Subscriptions renew according to the terms shown at purchase until you cancel them through your Apple Account subscription settings. We do not receive your full payment-card details.

RevenueCat helps us validate transactions, restore purchases, and determine whether an entitlement is active. RevenueCat does not create a login account for you. If a purchase or restore does not appear, the app may need a network connection and the transaction may need to be reviewed by Apple or RevenueCat.

Your content and feedback

You retain your rights in information you enter into the app. You give us only the limited permission reasonably needed to provide the Service, troubleshoot a request, and operate the third-party services described in our Privacy Policy. We do not claim ownership of your local diary.

If you send suggestions, feedback, or ideas, you allow us to use them without payment or restriction to improve the Service. Please do not send confidential information or another person’s health information.

Apple and other third-party services

The Service may interoperate with Apple Health, the App Store, RevenueCat, Firebase, PostHog, hosting providers, and other third-party services. Those services are not controlled by us and may have separate terms, privacy practices, fees, outages, or limitations. Your use of them is subject to their applicable terms.

Apple is not responsible for providing maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price where required by its terms. Apple has no other warranty obligation for the app to the maximum extent permitted by law.

Intellectual property

The Service, including its software, design, text, graphics, trademarks, and other materials, is owned by or licensed to Abhinav Khanger and is protected by intellectual- property laws. Except for the limited license in these Terms, no rights are granted to you. “Alcohol Tracker°” and related marks may not be used without permission.

Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, availability, or non-infringement. We do not warrant that calculations, estimates, content, or results will be complete, current, error-free, or suitable for your circumstances.

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business arising from or related to the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim or USD $50. Nothing in these Terms excludes liability that cannot legally be excluded or limits your mandatory consumer rights.

Suspension, termination, and changes

You may stop using the Service at any time. We may suspend or terminate access, or discontinue the Service, if reasonably necessary for security, legal, operational, or abuse-prevention reasons. Provisions that by their nature should survive termination, including intellectual-property, disclaimer, liability, and dispute provisions, will survive.

We may update these Terms when the Service or law changes. We will post the revised Terms on this page and update the date above. If a change is material, we will provide notice where reasonably practical. Your continued use after the effective date means the updated Terms apply to future use, subject to mandatory consumer protections.

Governing law and contact

To the extent permitted by law, these Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts with jurisdiction where the developer is established will have non-exclusive jurisdiction, except that you may have the right to bring a claim in the courts of your own country or state under mandatory consumer law.
